Amendments to the Federal Rules of Practice and Procedure Effective December 1, 2025

Congress has taken no action on the proposed amendments (PDF) to the Federal Rules of Appellate, Bankruptcy, and Civil Procedure adopted by the Supreme Court and transmitted to Congress on April 23, 2025. As a result, the amendments govern all proceedings commenced on or after December 1, 2025, and all proceedings then pending 'insofar as just and practicable'. Links to the text of the amended rules and the accompanying committee notes - along with extensive supporting documentation related to their adoption - are posted on the Current Rules page of the Judiciary's website.

The following Rules took effect on December 1, 2025:

Rule 3002.1 Chapter 13 - Claim Secured by a Security Interest in the Debtor's Principal Residence
Rule 8006 Certifying a Direct Appeal to the Court of Appeals

Federal Rules of Civil Procedure
Rule 16 Pretrial Conferences; Scheduling; Management
Rule 16.1 Multidistrict Litigation
Rule 26 Duty to Disclose; General Provisions Governing Discovery

In addition, amended and new official bankruptcy forms became effective December 1, 2025. As approved by the Judicial Conference, amendments to official bankruptcy forms govern all proceedings in bankruptcy cases thereafter commenced and, insofar as just and practicable, all proceedings then pending. There will also be one new Director's Form and two updates on December 1, 2025. The new and amended forms are posted on the Bankruptcy Forms page of the Judiciary's website.
