Local Rules Advisory Committee

Overview

Pursuant to 28 U.S.C. § 2071, Fed. R. Civ. P. 83, Fed. R. Bankr. P. 9029, and DUCivR 83-7.6, the United States District Court for the District of Utah (“District Court”) authorizes the bankruptcy court to adopt Local Rules of Practice (“Local Rules”) not inconsistent with title 11 and title 28 of the United States Code, the Federal Rules of Civil Procedure, the Federal Rules of Bankruptcy Procedure, and the District Court’s Local Rules of Practice. The court’s current Local Rules can be accessed here.

The court appoints an Advisory Committee to study the operation and effect of the Local Rules, to consider amendments to the Local Rules and the possible creation of new rules, and to correct and update the Local Rules. The Advisory Committee makes recommendations to the court based on its work, including taking into consideration suggestions and recommendations received from any source, new statutes, court decisions, and changes to the Federal Rules of Civil Procedure, the Federal Rules of Bankruptcy Procedure, and the District Court’s Local Rules of Practice. Recommendations accepted by the court are published for public comment, then submitted to the District Court for approval, ratification or modification. Once finalized, the court adopts Local Rule amendments by General Order and sets an effective date.

Membership

Membership on the Advisory Committee is generally comprised of a bankruptcy judge who serves as Chair, court personnel, local practitioners who represent the various constituencies appearing before the court, the Standing Chapter 13 Trustee, and a representative of the Office of the United States Trustee. Members are chosen after a public application process.
